1. Registration and Scope of Services
1.1 WINE+PARTNERS, Muhr & Watzlawick OG, Peter-Jordan-Straße 6/3, 1190 Vienna, Austria (hereinafter referred to as WINE+PARTNERS) provides the registered user with a registered area on the internet at https://wine-partners.at/ in order to manage the user’s event invitations (hereinafter referred to as “the platform“).
1.2 The platform is provided free of charge.
1.3 The user is obliged to fill in all data required for registration truthfully and completely. The user may only register once and may only create one user profile. Should there be any changes to the data entered, the user undertakes to inform WINE+PARTNERS of these changes immediately.
1.4 The user has no right to registration. WINE+PARTNERS reserves the right to block or delete registered users without giving a reason or to restrict or block access to the platform without giving a reason.
2 Rights and obligations of users
2.1 The user undertakes to keep their password secret and not to disclose it to third parties. The information contained on the platform is intended exclusively for the user.
2.2 WINE+PARTNERS reserves the right to delete content which the user has uploaded to the platform without giving a reason and without notification.
2.3 The user undertakes to indemnify WINE+PARTNERS against all claims by third parties relating to the user's content.
2.4 The user is not permitted to test the performance and/or speed of the platform. Its use may only take place within the framework of the defined interfaces or within the framework of the user interface.
3 Newsletter
3.1 The user's email address is used by WINE+PARTNERS to send promotional messages. The user can refuse the messages when their email address is collected and additionally with each message.
4 Disclaimer of warranty and exclusion of liability
4.1 Liability and warranty are excluded.
4.2 WINE+PARTNERS is not liable for the storage, transmission or the correct presentation of the content provided by users. Furthermore, WINE+PARTNERS accepts no liability for the topicality, correctness or quality of the results presented on the platform.
4.3 Should WINE+PARTNERS nevertheless be liable, the liability of WINE+PARTNERS shall be limited to € 500.
5 Final provisions
5.1 Austrian law shall apply. The UN Convention on Contracts for the International Sale of Goods is excluded. Any disputes shall be brought before the court that has the subject-matter jurisdiction for Graz.
5.2 General terms and conditions of the user shall not apply.
5.3 Amendments and/or supplements to the Terms and Conditions must be in writing in order to be legally effective; a written notification is also required for any waiver of this formal requirement.
5.4 If individual provisions of these Terms and Conditions are or become void, unenforceable and/or invalid, this shall not result in the voidness, unenforceability and/or invalidity of the entire contract. In this case, the parties undertake to agree on a provision in place of the void, unenforceable and/or invalid provisions which comes as close as possible in economic terms to the purpose pursued by the void, unenforceable and/or invalid provision.
